Warranty
Subject to the provisions, limitations, and exclusions outlined in this Warranty (the "Warranty"), Ella + Ross Inc. warrants to the consumer, for ONE YEAR from the date of purchase from the retailer, that all finishes, parts, and components of new furniture and merchandise (our "Products") are free from defective material and manufacturing defects only ("Defects") when used normally, as described herein.
Ella + Ross' liability under the terms of this warranty is restricted to the replacement of the defective component or part, repair of the defective product, or replacement of the defective product. Ella + Ross will attempt to rectify the defect by providing replacement parts; however, if this is not feasible, the defective product may be repaired or replaced at our discretion. If the issue can be resolved through minor repairs, Ella + Ross may authorize customary and reasonable labour rates prior to performing the repairs. If this occurs, Ella + Ross will reimburse you for the repair costs upon receipt of the invoice you paid for the repair. Ella + Ross shall not be liable for any expenses associated with the transportation of defective products to the purchaser's location (the retailer).
This Warranty grants protection exclusively to the initial purchaser and is strictly non-transferable. Explicit for residential use only, this warranty provides protection against defects and is applicable to contract-viable products in both residential and commercial environments. Placing a non-contract viable product in a commercial environment renders the warranty null and void. Any modifications made to the product, including re-upholstering, by a merchant, trade partner, or individual will render the warranty void.
This warranty excludes all conditions and damages that are not defects. This includes, but is not limited to, conditions and damages caused by neglect, misuse, abuse, accident, unreasonable or unintended strain or use, improper or inadequate maintenance, cleaning, or care, as well as damage to or failure of the finish caused by substances such as alcohol, water, fabric dye transfer, cleaning substances, or liquids. Product markings located on the reverse or underside are not regarded as defects. Credit notes that are issued in response to returns or damages must be applied to future orders within a period of one year from the date of issuance. Past-due credits will cease to be valid following the specified period.
The filing of a claim is required to occur within the warranty period. In the event that defects are discovered, it is incumbent upon the consumer to promptly notify the retailer (the location of purchase) accordingly. Ella and Ross should not be contacted regarding warranty claims.
Freight damage and manufacturing defects are regrettable aspects of the furniture industry that affect all commerce clients. To file a damage claim in the event that a shipment arrives damaged, kindly notify cs@EllaandRoss.com without delay. Please be advised that Ella + Ross does not cover any costs associated with the receiving or inspection of damaged products, including disposal fees, end-user delivery charges, or storage fees assessed by the receiving company.
This limited warranty encompasses all express and implied warranty rights of the purchaser and is exclusive. Ella + Ross provides no additional express or implied warranties. Ella + Ross hereby excludes and disclaims any implied warranties of merchantability or fitness for a particular purpose that surpass the obligations or time limits specified in this warranty. Both the buyer and Ella + Ross explicitly concur that the buyer has the exclusive right to request the replacement or repair of any defective product or component thereof. Beyond that, Ella + Ross makes no additional warranties or representations. Ella + Ross shall not be held liable for any incidental or consequential damages. This includes, but is not limited to, personal injury, loss of use, loss of time, inconvenience, or other economic loss, as well as loss related to property other than the products.
